Alabama Attorney General Troy King is asking a federal judge to dismiss a lawsuit accusing the state of violating overseas absentee voting laws.
The lawsuit says state voting officials failed to file reports on overseas absentee ballots as mandated by a 2002 federal law.
The U-S Justice Department filed suit against the state last month requesting that Alabama officials file the required reports for the November 4th general election.
King says the lawsuit should be dismissed because states are not required to file reports until 90 days after elections.
5,743 overseas absentee ballots were cast in the November 4th election.
