CLEVELAND, Tenn. (AP) - A jury has acquitted former state Sen. Jeff Miller on a charge of accepting pay for work he didn't do as Bradley County's delinquent tax attorney.

The Chattanooga Times Free Press reports the jury at Cleveland deliberated for less than three hours Wednesday after Miller's defense attorney called no witnesses.

The jury deliberated a charge of official misconduct after the judge agreed to dismiss charges of conspiracy to commit official misconduct and conspiracy to commit aggravated perjury.

The former Republican lawmaker and his secretary in Cleveland were both arrested in March.

She has made a deal with prosecutors and will not have to go to trial.

Miller, who didn't seek re-election to the Tennessee Senate in 2006, was removed as the county tax attorney in January.
