WETUMPKA, Ala. (AP) - A judge has sentenced an Opelika man to death for killing a young father during a truck hijacking in the parking lot of the Millbrook Wal-Mart.
A jury in Elmore County had recommended that 20-year-old Calvin McMillan receive a sentence of life without parole. But Circuit Judge John Bush imposed a death sentence Friday.
District Attorney Randall Houston said the family of 23-year-old James Bryan Martin was pleased with the judge's decision to impose the maximum sentence for capital murder.
Martin was a father of 2. He was shot four times Aug. 29, 2007, and his truck was stolen. Martin was on his way home from a Montgomery Biscuits baseball game and had stopped at the Wal-Mart to pick up diapers and baby wipes.
